SECTION 1: INTRODUCTION
The Freedom of Information Act 2000 (FOI) asserts the right of individuals to obtain access to official information to the greatest extent possible consistent with the public interest and the need to protect legitimate confidential information.
The Crown Estate currently makes information routinely available to the public in relation to its functions, activities and schemes. Such information will continue to be available without the need to use the FOI Act. This guide highlights, in relation to our activities, where information of this nature is already made available and where this information is included in our publication scheme. If you want further details about how to access this information please go to section 4 of this guide.
Where information is not included on our publication scheme or is not available on our website you will need to request the information. We have provided details about how you can make a request in section 5 of this guide.
SECTION 2: OUR PUBLICATION SCHEME
This guide provides information on the structure and activities of The Crown Estate to assist you in accessing information. One of the aims of the FOI Act is that public authorities should be clear and proactive about the information they will make public. An important part is the publication scheme.
What is a publication scheme?
The publication scheme (this guide) is a comprehensive outline of the information that The Crown Estate routinely make available to the general public. In section 8 of this guide we provide details of the additional classes of information made available from the 30 November 2002. The scheme also sets out the manner in which information can be obtained and whether the information is available free of charge or on payment. Details of fees and formats for documents held in the publication scheme are set out in section 7.
SECTION 3: THE ROLE OF THE CROWN ESTATE
The Crown Estate is a landed estate including over 120,000 hectares of agricultural land in England, Scotland and Wales, substantial blocks of urban property and almost half the UK foreshore, together with the seabed out to the 12-mile territorial limit. Its origins date back to the reign of King Edward the Confessor.
The Crown Estate is part of the hereditary possessions of the Sovereign “in right of the Crown”, managed under the provisions of The Crown Estate Act 1961 by The Crown Estate Commissioners who have a duty to maintain and enhance the capital value of the Estate and the income obtained from it, with due regard to the requirements of good management.
All the net revenue is paid annually to the Treasury.
Our portfolio and extensive range of financial and environmental responsibilities built on almost 1,000 years of history make The Crown Estate a unique organisation. Adding value through sensitive and imaginative management is just as important to us as meeting our financial objectives. In our approach, we combine traditional values such as efficiency and responsibility with leading-edge best practice principles and professional standards, while using the latest IT applications.
Nearly 500 staff work at nine separate locations throughout the UK. The main headquarters, on London's Regent Street, accommodate people working in the urban, marine and rural estates, as well as those in central support functions such as finance, IT services, legal, communications and HR. The Chairman and Chief Executive are also based there, and most formal meetings of the Board of Commissioners are held there.

Information already available on our website may be accessed without using the FOI Act.
The material featured on The Crown Estate's site is subject to copyright protection. The Crown Estate authorises visitors to the site to make one free copy, by downloading to printer or to electronic, magnetic or optical storage media, of any items featured on the site for the purposes of private research, study and reference.
Any other copy or use of copyright materials featured on the site, in any form or medium, is subject to the prior approval ofthe copyright owner. For details please email .
Information included in our publication scheme
Our publication scheme refers to all kinds of information, which we publish both for internal use and externally. The scheme has been active from 30 November 2002. Publication does not refer solely to printed material. It also includes information in other formats such as electronic documents. Please see section 8 of this guide for details of the classes and documents.
The classes in the scheme are based on information type, which should be meaningful to users, and no knowledge of our organisational structure is required to navigate around the scheme.

SECTION 5: HOW TO ACCESS INFORMATION NOT INCLUDED IN THE PUBLICATION SCHEME
Applications under the Code of Practice on Access to Government Information
(Effective up to January 2005)
The Code of Practice on Access to Government Information will remain in force until the FOI Act comes fully into force in January 2005. Applications under the Code of Practice to see information that is not in our publication scheme should be put in writing and should provide as much detail as possible to identify the information sought. The target for response to simple requests is 20 working days from the date of receipt. There is no charge in relation to requests made under the Code of Practice.
Please note this procedure does not cover requests where you are asking for details relating to information about you as an individual. These requests are subject to the provisions of the Data Protection Act. See below.
What you need to do
Applications should be in writing and include your name and correspondence address. You should also provide as much detail as possible to enable The Crown Estate to identify the information sought.
If information is required in a particular way (for example, a photocopy or on computer disc, or in large type) this should also be stated in the application. If you have difficulty in identifying the precise information you require, or difficulty in making the application in writing, our staff will be pleased to help you.

How much will it cost?
The Crown Estate may charge a fee, which will have to be calculated according to Fees Regulations. Under the FOI Act, fees may be charged in respect of the time spent in efficiently locating or copying records, based on a standard hourly rate.
No charges may apply in respect of the time spent by The Crown Estate in considering requests. If a fee is required, the 20 working days will be extended by up to 3 months until the fee is paid.
Applications under the FOI Act 2000 (from January 2005)
Under the FOI Act, anyone is entitled to request information not otherwise publicly available. Please note that the FOI Act does not cover requests where you are asking for details relating to information about you as an individual. These requests will continue to be subject to the provisions of the Data Protection Act. See below.
Two of the main features of the FOI Act are:
- A general right of access to information held by The Crown Estate, subject to certain conditions and exemptions.
- In cases where information is exempted from disclosure, except where an absolute exemption applies, a duty on The Crown Estate to inform the applicant whether they hold the information; and communicate that information to the applicant unless the public interest in maintaining the exemption in question outweighs the public interest in disclosure.
The Crown Estate is obliged to respond to requests within 20 working days of receipt of the request.

SECTION 6: COMPLAINTS AND APPEALS PROCEDURES
Complaints procedure under the Code of Practice on Access to Government Information
The Crown Estate operates the following complaints procedures under the Code of Practice, which remains in force until the individual right of access under the FOI Act comes into force in January 2005.
The Code provides for both internal and external complaints procedures. Complaints that information which should have been provided under the Code has not been provided should be made to The Crown Estate in the first instance and sent to the following address:

An independent official who has not been involved with the request will then undertake the internal review.
The applicant will be informed of the outcome of the review in due course. If an applicant remains dissatisfied, complaints may be made through a Member of Parliament to the Ombudsman. Complaints will be investigated at the Ombudsman's discretion in accordance with the provisions provided in the 1967 Act.
Rights of review and appeal under the FOI Act (from January 2005)
The FOI Act sets out a series of exemptions to protect confidential or other information where disclosure may prejudice the interests of the State or of third parties. Where The Crown Estate invokes these provisions to withhold information, that decision is subject to a review process.
Decisions about deferral of access to information, the way in which access is given or the level of fees or charges, are also subject to review. The two review processes are set out below.
Rights of internal review
If you are dissatisfied with the response from The Crown Estate you may seek an internal review of that decision. That review will be undertaken by a senior manager who has not previously been involved with your request.
If you have not received a response from The Crown Estate within 20 working days of receipt of your initial application, it is likely to be regarded by the Information Commissioner as amounting to a refusal of your request and allows you to proceed to internal review.

An internal review must normally be completed before an appeal may be made to the Office of the Information Commissioner.

If you are dissatisfied with the outcome, or the handling, of the internal review conducted by The Crown Estate, you may seek an independent review from the Information Commissioner. Requests for a review by the Information Commissioner should be made in writing directly to:

SECTION 7: FORMATS AND FEES FOR INFORMATION HELD ON OUR PUBLICATION SCHEME
Information is provided in English. If you require information to be provided in any other language we will charge a fee to cover translation costs. Large type versions are available on request.
Information is available free of charge from our website i.e. there is no charge by us but you will need to meet any charges by your internet service provider, printing costs etc. For those without internet access, a single copy is available from the contact details below. Requests for multiple copies may attract a charge for the cost of retrieval, photocopy and postage etc. We would let you know this at the time of your request (the charge would be payable in advance).
Formats for each class of information are shown in Section 8.
We intend to make most of our information available online when this becomes practicable. In the interim information in the publication scheme can be requested from:
